Welcome to wormhole by Design3.

This Privacy Policy (“Policy”) details the manner in which Design3 Network Limited (“Design3”/“us”/“we”), a company incorporated under the provisions of the Companies Act, 2006 on February 10, 2024 bearing Company No. 15479457 and having its registered address at 203 Astell House, 35 Lyell Street, London, England, E14 0SU, collects, stores, processes, uses and shares the personal information provided by you or in relation to you while accessing and/or using the web app wormhole, accessible at thewormhole.co or any additional or replacement web app operated by Design3, which may be mentioned in these Terms (hereinafter referred to as “the Web Apps”) and any services provided on or through the Web Apps (hereinafter referred to as “Services”).

Please do not access or use the Web Apps or Services unless you have read, understood and consent to your personal information being collected, stored, processed, used and shared in the manner specified by this Policy and the Terms of Use. If you access or use the Web Apps or Services, regardless of whether you have registered or signed up for an account or purchased membership on the Web Apps, you are deemed to have accepted this Policy as well as the Terms of Use.

We may update or revise the Policy at any time. If we do so, the updated or revised Policy will reflect on this page. Your continued use of the Web Apps after such an update or revision signifies your acceptance of these changes.

1. What is Personal Information?

“Personal Information”, as defined in Regulation (EU) 2016/679, i.e. the General Data Protection Regulation, refers to information relating to a natural person who is directly or indirectly identifiable, with reference or regard to identifiers such as a name, identification number, location data, online identifier, characteristic, trait, attribute or any factor specific to that person’s physical, physiological, genetic, mental, economic, cultural or social identity.

You have the right to opt out of accepting this Policy. However, in this case, please note that you may not be able to access the Web Apps or Services or receive or access answers to any questions you may have asked us.

2. What Personal Information do we collect?

During your access or use of the Web Apps or Services, we may collect the following Personal Information:

  • Any data that you enter into the Web Apps, including but not limited to name, age, email address, date of birth, phone number, address, location, employer/company name and size, designation/title, preferred topics/content, areas and level of expertise, credit card details, etc.;
  • Information regarding your actions on our Web Apps, including your search queries and user prompts;
  • Information collected by automated means, as explained in our ‘Cookie Policy’ below;
  • Any material that you upload or post or otherwise make available on or through the Web Apps.

The collecting and retaining agency with respect to your Personal Information is Design3 Network Limited. We may maintain a back-up copy of your Personal Information on the following platforms: Mixpanel, Stripe, Design3’s cloud servers on Microsoft Azure, Zapier or Squarespace.

In addition, financial or payment information may be collected from you if you purchase or subscribe to any Services or other features on the Website. Financial or payment information is collected and held by third-party service providers, i.e. Stripe, Microsoft Corporation (for the Azure platform), Squarespace, Inc. and Google. We are not liable for any information created or stored by these third-party service providers. We will update this Privacy Policy in the event we use any other third-party service provider.

3. How do we process your Personal Information?

We process and/or use your Personal Information to:

  • Provide products and services to you;
  • Gather feedback from you in order to monitor and improve our products, services and Web Apps;
  • Communicate with you;
  • Research and develop new products and services and ways to improve your experience with our Web Apps and services, including artificial intelligence (AI)-based training and personalisation;
  • Evaluate, monitor and improve the working of our Web Apps and business;
  • Promote and advertise our products and services to you;
  • Provide services or information to you and communicate with you based on your specific requests.

Your Personal Information is stored only for as long as needed to fulfil the above aims.

Profiling

Profiling is an automated process that enables us to use your personal data to build a profile about you. This is one of the tools we use to analyse your online activities including user behaviour. We may also analyse your participation in surveys, email preferences and activity on social media channels.

We use profiling to help us assess your likely preferences and interests and tailor content, resources and responses to you. If you have an account with us, we may use profiling to select certain members so that we can send them tailored promotions or communications.

Profiling helps us only contact you about matters that we believe will be of genuine interest to you. You may withdraw your consent to prevent your personal information being used in this way at any time by using the manage cookies section of our Cookie Notice or by following the guidance set out for withdrawal of consent below.

4. Is your Personal Information shared with third parties?

We do not sell your Personal Information to any third party.

However, we share your Personal Information internally within Design3 and may also share this information in connection with a business transfer. As we continue to develop our business, we may sell or purchase assets, subsidiaries or business units. In such transactions, your Personal Information generally is one of the transferred business assets but remains subject to this Privacy Policy.

If another entity acquires us, our business, or substantially all or part of our assets, or assets related to the Web Apps, your Personal Information will be disclosed to such entity as part of the due diligence process and will be transferred to such entity as part of the transaction. If any bankruptcy or reorganization proceeding occurs, your Personal Information may be sold or transferred.

We may share or disclose your Personal Information where you have provided specific consent for us to do so.

We will also disclose Personal Information where legally required, including:

  • To comply with any applicable law or court/authority order;
  • To comply with a legal obligation or government request;
  • To respond to or fulfil claims against us by third parties;
  • To protect our rights or property or those of others;
  • To detect and protect against fraud or security vulnerabilities;
  • To enforce our Terms or any other agreements.

We use Microsoft Azure and SquareSpace to host the Web Apps. Some data may also be hosted on MixPanel and Stripe. Due to this, your Personal Information may be stored on or transferred to servers outside the United Kingdom. Such transfer is necessary for us to provide Services to you. We will update this Policy in the event we use any other provider.

5. What is our Cookie Policy?

Like nearly all Web Apps, we use “cookies” to collect certain information when you visit the Web Apps. Cookies are small text files saved on your computer that allow us to deliver a better and faster experience.

You can disable cookies through your browser settings, set a “Do Not Track” preference, or disable cookies directly on our Web Apps. However, this may restrict your ability to access or use certain features.

Please note that we do not control any third-party cookies that may collect information when you access the Website.

6. Can you ‘opt out’?

Yes, you have a legal right to opt out from the use of your Personal Information for direct marketing. If you wish to do so, please click the “Unsubscribe” option in any marketing email sent by us.

7. What is the legal basis for processing your Personal Information?

  • If processing is necessary for performance of the Terms;

8. What rights do you have over your Personal Information?

You have the following rights with respect to your Personal Information:

  • Right to request access or review of your Personal Information, including rectification, completion, updating, amendment or erasure;
  • Right to request deletion under certain circumstances;
  • Right to withdraw consent for subsequent processing;
  • Right to data portability (structured, commonly used, machine-readable format);
  • Right to file a complaint with a supervisory authority under GDPR;
  • Right not to be subject to automated decision-making, including profiling, under certain circumstances.

9. California Consumer Privacy Act, 2018

Users based in California, USA have the following additional rights:

  • Right to know what personal information we have collected and to access such information;
  • Right to know whether and to whom your personal information has been sold or disclosed;
  • Right to object to the sale of your personal information;
  • Right to request deletion of your information unless exempted under CCPA;
  • Right not to be discriminated against for exercising rights;
  • Right to request disclosure (up to twice in 12 months) of categories and specific details of information collected or sold, including:
    • The categories of personal information collected
    • The categories of sources from which the personal information is collected
    • The business or commercial purpose for collecting or selling personal information
    • The categories of third parties with whom we share personal information
    • The specific pieces of your personal information we have collected
    • The categories of your personal information that we have disclosed for a business purpose
    • The categories of your personal information that we have sold and the categories of third parties to whom such information has been sold and the category or categories of personal information for each third party to whom the personal information was sold
  • “Do Not Sell My Personal Information”: Right to opt out;
  • Third Party Marketing: The right to request information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing purposes.

We aim to ensure that your Personal Information remains secure and comply with reasonable security practices and procedures by following industry standards and internal technical measures. However, complete security cannot be ensured or guaranteed.

12. Policy regarding Children

At Design3, we do not directly market to children. Our Web Apps are intended for adults aged 18+. In compliance with GDPR, we do not solicit or knowingly collect, use, process, or store information in relation to individuals under 18. If any Web Apps are intended for younger users, we will obtain explicit parental consent, which may vary by country based on jurisdictional requirements.

Changes to these Terms of use

We may update our Terms of use Policy from time to time. We will let you know via email or a prominent notice on our Website, prior to the change becoming effective.
Changes to this Privacy Policy are effective when they are posted on this page.
